China Expands Domestic Violence Protections to Cohabiting Couples
China's top prosecution authority said on Tuesday that unmarried couples who live together will now be legally recognized as family members under domestic violence laws.
The change means abuse between cohabiting partners can be handled as domestic violence, extending legal protection beyond married couples.
Ge Xiaoyan, deputy procurator-general of the Supreme People's Procuratorate, said the shift reflects evolving social norms and the growing number of cohabiting couples.
The SPP also stated that non-physical abuse, including emotional and mental harm, qualifies as domestic violence, broadening the definition beyond physical injury. Prosecutors said they will impose tougher penalties on habitual abusers, especially those whose violence stems from alcohol, gambling or drug use.
Authorities also signaled leniency for victims who injure or kill their abusers after prolonged abuse, saying prosecutors will weigh motives, circumstances and past violence, and may decide against arrest or prosecution in cases meeting self-defence criteria.
Victims are urged to report abuse, keep evidence and apply for personal safety protection orders. Women's federations and community organisations can provide support in urgent cases.
