Fatal Crash Highlights Risks of Driver Assist Misuse
A driver in Shanghai has been held primarily responsible for a fatal crash after relying on a driver-assistance system and becoming distracted at the wheel, local authorities said.
The case, recently released by the Shanghai Pudong People's Procuratorate, occurred on April 13, 2025, on Longdong Avenue in Pudong New Area. A black SUV traveling in the innermost lane crashed into a stationary road maintenance vehicle, striking two workers who were removing warning cones. One of them later died despite emergency treatment.
Investigators found that the driver, surnamed Dong, had activated adaptive driving assistance while overspeeding at 83 km/h. He bent down to pick up a dropped drink bottle and failed to notice traffic conditions ahead in time to avoid the collision.
Technical assessments confirmed the vehicle's steering and braking systems were functioning normally and that the driver-assistance feature was engaged. Authorities concluded that Dong bore primary responsibility due to speeding and inattention, while the maintenance company was assigned secondary liability for failing to deploy protective vehicles at the work site.
Dong later compensated the victims and their families and reached a settlement. Prosecutors said his actions constituted the offense of causing a traffic accident but deemed the circumstances relatively minor given his confession and cooperation, deciding not to pursue charges. His driver's license has since been revoked.
Authorities used the case to stress that driver-assistance systems do not replace human responsibility, warning motorists to remain fully attentive even when such features are in use.
